2.2. “Checkout” refers to completion of the cart checkout process on our App/Website that results in an Order confirmation;

2.6 “Independent Contractor” refers to any third party individual rider or rider company engaged by the Company to provide delivery service;

2.7 “Operating Hours” means any time and day during which a Premise is open to the general public.

2.8 “Platform” means www.select.talaadthai.com, an internet domain property registered under TalaadThai Select.

2.9 “Privacy Policy” means the agreement as displayed on this site, governing how we collect and store data;

2.10 “Service” or “Services” refers to which we may supply, and you may request from our Website;

2.11 “Service Fee” refers to the delivery charges and shopper fees that you will be charged upon placing an Order on www.select.talaadthai.com ;

2.12 “Total Bill” refers to the total price for Delivery, Goods or Services ordered, including any other charges or taxes, that shall be charged to you upon completion of your Delivery;

2.13 “We”, “Us”, “Our”, “Company” “TalaadThai Select”, all reference to the company;

2.14 “Website” refers to www.select.talaadthai.com or any subdomain thereof on which we offer our Goods and Services

2.15 “You”, “Your”, “Yours” “User” refer to you, the person accessing this Website to order Goods and Services from the Website or any other way to order from TalaadThai Select;

3.1.4. Only one (1) TalaadThai Select account is allowed for each registered phone number. Additional accounts may be allowed at our discretion. Furthermore, the number of devices you may use to log into your TalaadThai Select account may also be subject to limitations.

3.4. Price and Product

3.4.1. All prices set by TalaadThai Select or Participating listed on the Website are guide prices only and are only approximate. We reserve the right to change these prices at any time. Prices are inclusive of the relevant sales tax. We also reserve the right to alter the Goods or Services available for sale on the Website and to stop listing Goods or Services at any time we think fit.

3.4.2. Your Total Bill may vary from the guide price initially displayed on the Website when you placed your Order. This difference of price can be due to one or more of the following reasons:

1) Replacements – When the original item you ordered is unavailable at the Premises, we may instead deliver you a replacement item that you can choose to accept or decline. If you accept the replacement item, you will be charged its full price instead of the price of your original item.

2) Changing in-store prices – The prices at the Participating Retailer’s Premise may vary on a daily basis and the final price charged to you is subject to our discretion. Unless otherwise communicated, the price of the item you will be paying will be the price as stated on the Website on the day you ordered. This price is stated in your Order confirmation email. Should price changes be required, we will endeavor to communicate this with you before the completion of your Order.

3.4.3. All prices for delivery by TalaadThai Select or a third party provider assigned by TalaadThai Select listed on the Website are correct at the time of publication, however, we reserve the right to alter these in the future.

3.4.4. The total price for Goods and Service Fee, including other charges (if any), will be displayed on the Website when you place your order at the check-out process. The Final Bill may change due to the reasons listed in 3.4.2. and / or due to rejections during the delivery confirmation process. 

3.4.5. If you choose online payment, you must provide your payment details before the order is delivered. To ensure that shopping online is secure, your debit/credit card details will be encrypted to prevent the possibility of someone being able to read them as they are sent over the Internet. Your credit card company may also conduct security checks to confirm it is you placing the order.

3.4.6. We do not provide store receipts for your Order. A digital order confirmation and payment receipt will be emailed to you upon completion of your Order. If you require an official tax invoice, you may reach out to our customer service department.

3.5. Delivery  

3.5.1. We will deliver strictly based on the item’s quantities indicated in your checked-out cart or confirmation orders. 

3.5.2. Delivery periods quoted at the time of ordering are approximate only and may vary. Goods will be sent only to the address provided by you in the ‘Delivery Address’ section. Customers are not allowed to change the delivery address after the Order is confirmed. Please note that delivery address inaccuracies and/or discrepancies may result in order cancellation. TalaadThai Select delivery service is available in selected areas. You are advised to check the Website on the designated delivery area prior to your placement of any Order. We shall reserve our rights to inform you earlier and to cancel your Order if we are unable to deliver to your location.

3.5.3. The delivery periods selectable are the following 1-7 calendar day. There is a limited amount of slots available in each delivery period, meaning that we cannot guarantee that you will be able to choose the delivery period you desire. Such inaccessibility of delivery periods will be indicated by the Website.

3.5.4. We require a minimum spending of an amount as stated in our website on the selected Participating page to entitle for the delivery services. If you do not reach the minimum amount, you will be responsible for the delivery cost incurred.

3.5.5. TalaadThai Select may employ third party providers to ensure delivery of Goods and Services in the timeslot selected on the Website. We will take great care to ensure that delivery is done in the timeslot selected on the Website; however, we will not be liable for any loss caused to you by late delivery. If the goods are not delivered in the timeslot agreed upon, or for any other inquiry regarding delivery, please contact our authorities, as indicated by the Website.

3.5.6 (English Version)

3.5.7. Our driver will only wait for fifteen (15) minutes from the slot time once they arrive at your selected delivery address. If you are unable to collect your Goods and/or refuse/delay/fail to respond to our communications regarding Goods collection within this time-frame, the Order will be classified as a ‘failed delivery’ and the rider will return to the Premises with all the items. If you wish to have re-delivery, TalaadThai Select is willing to deliver that product to you again upon your delivery periods selectable. However, You will be responsible for any additional re-delivery cost incurred.

3.5.8. You must ensure that at the time of Delivery of Goods adequate arrangements, including access where necessary, are in place for the safe delivery of such goods. We cannot be held liable for any damage, cost or expense incurred to such goods or premises where this arises as a result of a failure to provide adequate access or arrangements for delivery.

3.5.9. We shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

3.5.10. For the purposes as described in Article 3.5.6. herein, you understand, agree, and give consent that TalaadThai Select may provide your delivery address to a third party as our logistic partner to perform the delivery of Goods.

3.6 Rejection and Refund

3.6.1. You are advised to check, inspect, and examine your items upon delivery. Our driver will assist you in this process. You are entitled to reject items that you deem unacceptable by giving reason to our rider. TalaadThai Select reserves the right to approve or disapprove your request and our decision is final. The total price of all such rejected items will be deducted from your Total Bill upon approval from TalaadThai Select management, net of discount.

3.6.2. We allow you to reject the following category of Goods within the specific time:

1) Perishable Goods and Semi Perishable Goods (example fish, vegetables, dairy products, fruits, bread etc.) – at the time of delivery.

2) Non-Perishable Goods (example Dry Grocery, condiment.) – at the time of delivery

3.6.3. We reserve the rights to request from you proof of damaged, substandard or missing Goods (photograph). Refunds will be made at our sole discretion and will only be processed upon our review and successful verification of proof and/or collection of the item(s) from you by our rider. We will provide a status update on the refund to you via email as soon as practical.

2) Usage of multiple TalaadThai Select accounts for purchases related to TalaadThai Select promotions; and/or 

3) Creation of account on behalf of another person or entity without their authorization.

3.7.3. In the event that: (1) our systems detect multiple accounts being linked to your phone number; (2) payment methods that we deem suspicious; (3) multiple instances of payment failure; or (4) any of the information given is incomplete, invalid, false or wrongful, we reserve the right to:

Cancel any of your current or future Orders;

Immediately terminate your access to our Services without further reference to you;

Suspend your TalaadThai Select account and/or payment accounts indefinitely; and

Immediately cease all further communication with you.

Both we and you hereby submit to the non-exclusive jurisdiction of the Thailand Courts.
